Arvis Loft

Last updated: 2026-08-21·Version: 1.4

Terms and Conditions

Welcome to Arvis Loft. These terms set out the rules for using the app and the relationship between you and us. They are written as clearly as possible; please read them before using the service.

1. Who we are

The Arvis Loft app (the "Arvis" brand) is provided by:

COMEXIM ELECTRONIX SRL

  • Registered office: Suceava, Str. Tineretului nr. 2, bl. 33, sc. A, ap. 4, Suceava County, Romania
  • Trade Register: J2019001287330 · VAT/Tax ID (CUI): RO41380985
  • E-mail: office@arvis.ro · WhatsApp: +40 741 250 134

These identification details are made available permanently and free of charge, in accordance with Legea 365/2002 (Romania's e-commerce law).

The address office@arvis.ro is our single point of contact for writing to us directly about any aspect of the service, including for the purposes of Regulation (EU) 2022/2065 on digital services. We do not rely solely on automated tools: there is a person behind that address.

2. Which documents form the contract

The contract between you and us consists of:

  1. these Terms and Conditions;
  2. the Privacy Policy;
  3. the Refund and Withdrawal Policy;
  4. the Cookie Policy;
  5. the Your GDPR Rights policy;
  6. the Referral Programme Terms, if you take part in it;
  7. the Data Processing Agreement (DPA), if you use the service for professional purposes.

If they conflict, the order above decides, with one exception: on data protection matters, the Privacy Policy and the DPA prevail.

3. Accepting the terms, and our record of it

We ask you to accept these terms explicitly, by ticking the box when you create your account. We do not use pre-ticked boxes.

We keep a record of your acceptance: your account, the moment of acceptance, the version of the documents accepted, and minimal technical data (IP address and browser type). We keep it so we can prove, if it is ever needed, exactly what you accepted and when. You can see the version you accepted at any time in Settings.

If you do not agree with these terms, please do not create an account and do not use the service.

4. Definitions

  • Service / App: the Arvis Loft SaaS platform, accessible via the web.
  • Operator / we: COMEXIM ELECTRONIX SRL.
  • User / you: the person who creates an account and uses the app.
  • Consumer: a user who is a natural person using the service for purposes outside their trade, business or profession. Some rights in this document apply to you only if you are a consumer; we mark those explicitly.
  • User content: the data you enter or import: pigeons, pedigrees, photos, race results, training records, health records, notes and more.
  • Subscription: a paid plan (Standard or Pro).

5. Description of the service

Arvis Loft is an app for racing-pigeon breeders. Among other things, it lets you:

  • manage your pigeon list, with photos, status and history;
  • build family trees and export professional pedigrees as PDFs;
  • record and follow races and training flights, with placings and speeds;
  • keep a health journal and an activity calendar;
  • see statistics and analysis about your flock;
  • import data from CSV or Excel files;
  • pull in rankings published on external sources such as columba.ro;
  • scan pedigrees using an artificial-intelligence model (optional feature);
  • publish, if you choose, a public verification page for a bird;
  • export or delete your data at any time;
  • recommend the app to others through the referral programme.

Some features (for example a marketplace) are planned but not available. We do not promise features that do not exist.

6. Account and eligibility

  • To use the service you must be at least 18 years old and have full legal capacity. You confirm this when you create your account, by ticking the acceptance box. If we learn that an account was created by a minor, we close it and refund in full any amount paid.
  • You are responsible for keeping your password confidential and for all activity in your account.
  • An account belongs to a single person. Account details must be real and current.
  • If you notice unauthorised use of your account, tell us immediately at office@arvis.ro.

7. Plans, price, payment and renewal

Arvis Loft has a Free plan and paid plans, Standard and Pro. Current prices, what each plan includes and its limits are shown on the pricing page and in Settings → Billing, before any payment.

  • The charging currency is EURO. For users in Romania we also display an approximate amount in lei, marked with "~", purely for information. The amount actually charged is the one in euro.
  • Payments are processed by Stripe. We do not store your card details.
  • Renewal is automatic, at the end of each period, at the price in force at that time. You can stop it at any time in Settings → Billing, without penalty and without giving reasons. Cancellation takes effect at the end of the period already paid for; until then you keep access.
  • We e-mail you the invoice. We issue fiscal invoices in accordance with Romanian law.
  • Alongside a subscription you may buy scan top-ups, paid once, with no renewal.

Price changes. If we change the price of a plan, we notify you by e-mail at least 30 days in advance. The new price applies from the next renewal. If you disagree, you can cancel before renewal, at no cost.

Pre-contractual information. At checkout we provide, in accordance with Art. 8 of Legea 365/2002, the technical steps for concluding the contract, whether it is stored and how it can be accessed, the means of correcting input errors, the language of the contract, and any applicable codes of conduct.

The right of withdrawal and refunds are set out in the Refund and Withdrawal Policy.

Non-payment. If a payment fails, we allow a grace period and retry, letting you know. If payment still fails, the account moves to the Free plan. We do not delete your data for non-payment: it stays accessible within the Free plan limits, and export remains available.

8. Acceptable use

When using Arvis Loft, you agree not to:

  • upload unlawful or defamatory content, content that infringes others' rights, or other people's personal data without a lawful basis;
  • use the service fraudulently or to mislead;
  • subject the app to technical abuse: scraping, unauthorised access, circumventing plan limits, circumventing security measures;
  • resell, redistribute or offer the service as your own, without our written agreement.

Fair use. The service has technical limits (number of birds, scans, exports, request frequency), shown in the app. They are designed for normal use by a breeder. If a usage pattern affects platform stability or its costs in a plainly disproportionate way, we write to you first and look for a solution together; technical measures are the last resort.

9. Your content and your responsibility for it

Your data is yours. You own the content you enter or import. You grant us only a limited, non-exclusive, revocable licence to store, process and display that content solely in order to operate the service for you (for example to display your pedigrees, generate PDFs, calculate statistics or make backups). The licence ends when you delete the content or the account.

Within those same limits, the content may also be processed by our technical suppliers (hosting, e-mail, and, if you use pedigree scanning, the AI model provider). They act as our processors, under contract, strictly for the purposes above, and may not use it for their own purposes. The full list, with each one's role, is in the Privacy Policy.

Your pedigrees and data are private by default. They become public only if you explicitly choose to publish them. We do not use your content for other purposes, we do not sell it, and we do not train models on it.

You are solely responsible for the data you enter or import, for its accuracy, lawfulness and currency. This includes, without limitation:

  • the correctness of ring numbers, dates of birth, parentage links and results;
  • your right to use the photographs and documents you upload, including copyright in them;
  • data concerning other people (for example the name of a bird's previous breeder, taken from a certificate or a scanned pedigree). You confirm that you have a lawful basis for entering it into the app and that, where the law requires it, you have informed those people.

We do not, and cannot, verify the accuracy of your content. A pedigree, certificate or public page generated from incorrect data remains your responsibility.

If a third party complains to us about content you entered and the complaint proves well founded, you may reimburse us for reasonable costs incurred. This obligation does not apply if you are a consumer.

10. Automatically sourced data: import, external sources and AI scanning

The app can bring in data without you typing it. Each route has its limits, and it matters that you know them.

File import (CSV, Excel). We match the columns in your file to the app's fields and show you a preview before saving. The result depends on the structure and correctness of your file. You confirm the import.

Pulling from external sources (for example columba.ro). We may retrieve rankings published publicly by organisers or federations and match them to your birds by ring number. This data is not ours and we do not control it: it may be incomplete, may be corrected later at the source, may contain typing errors, and matching by ring can go wrong (for example with a purchased bird whose ring flew for its previous owner). We always ask you to confirm before saving it to a bird's record.

AI pedigree scanning. The feature is optional. We use an AI model that reads the uploaded image or PDF and extracts the text. AI models make mistakes, especially with handwriting, skewed or poorly photographed documents, and unusual languages or formats. That is why the result is always shown to you for review and nothing is saved without your confirmation. The model is operated by a third-party provider, Anthropic, PBC (United States), under the transfer safeguards described in sections 5 and 6 of the Privacy Policy.

What this means legally. We provide tools that save you time; we do not warrant the accuracy of data obtained through them and we are not liable for the consequences of using automatically sourced data that you have confirmed. Verification stays with you, and the app always gives you the chance to do it before saving.

What we do take on. We are responsible for the tools themselves working correctly: their availability, their integration with your account, and the result being shown to you for review before it is saved. We do not take on the errors inherent to AI models (handwriting, poorly photographed documents, unusual formats), because those are a limit of the technology, not a defect of the service. We do not state an accuracy rate: it would be a figure we could not honestly stand behind for every document.

If a scan comes out badly, we redo it free. You request a rescan straight from the app, with no e-mail to send and nothing to prove. A rescan is not deducted from the number of scans included in your plan. If the second attempt is still unusable, your rights under section 21 and under Romanian GEO no. 141/2021 remain untouched.

Nothing in this section limits our liability for the functioning of the service itself, nor any rights the law reserves to you as a consumer.

11. Public sharing

For any bird you may publish a public verification page, reachable by link or QR code. The feature is off by default and is switched on bird by bird, by you.

When you switch it on, the following become publicly visible: the bird's details, your breeder name, the loft, the family tree across several generations, and the ancestors' results. Details of birds that belonged, or belong, to someone else may therefore also be visible.

A published page can be found by search engines, not only by whoever has the link, and when the link is shared on social networks or in messaging apps it may be displayed with a preview image (the bird's photo). Bear this in mind when deciding what to publish.

By switching it on you confirm that you have the right to publish this information. You can stop publication at any time; the page becomes unavailable immediately, but we cannot control copies or screenshots taken while it was public, nor copies held temporarily by search engines or by the platforms it was shared on.

12. Referral programme

You can recommend the app to others and receive a share of the revenue generated. The programme has its own rules, including tax rules, in the Referral Programme Terms.

13. Intellectual property

The software, design, trade marks, logos, texts and pedigree templates of the Arvis Loft app (other than content you enter) are the property of COMEXIM ELECTRONIX SRL or are used under licence. You may not copy, decompile, modify or reuse them without our written agreement.

The documents you generate from your own data (PDF pedigrees, exports) are yours to use freely, including commercially, in your activity as a breeder: you may print, distribute, publish and hand them to buyers, without asking us and without any further payment. The restriction above concerns the templates themselves: you may not extract, recreate or use them to build a competing product.

14. Availability, maintenance and features in testing

We strive to keep the service continuously available, but we do not offer a guaranteed service level (SLA). We may carry out maintenance; where it is planned and has an impact, we announce it in advance.

Some features may be offered as beta or "in testing", labelled as such. They may be unstable, may change and may be withdrawn. Do not rely on them as your only source for important decisions.

15. Changes to the service and to these terms

The service. We may improve, change or withdraw features. If a change negatively affects your access to, or use of, the service other than to a minor extent, we notify you in advance by e-mail, describing the change and its date, and if you are a consumer you have the right to terminate the contract within 30 days, at no cost, with a refund of the amount paid and not consumed. The valid reasons for which we may change the service are: adapting to legislative changes or requirements of authorities, security reasons, changes imposed by our technical suppliers, and the technical evolution of the product. That last reason has a limit we bind ourselves to: we will not invoke technical evolution to withdraw a core feature of the plan you have paid for, during the period already paid. The change carries no additional cost for you. This section implements Art. 19 of OUG 141/2021 (Romania's transposition of Directive (EU) 2019/770).

The terms. We may update this document. Changes are of two kinds, treated differently.

Material changes are those that change your rights, the price or your obligations: the fees, the duration or renewal of the subscription, the limits of your plan, our liability, or the deadlines and procedures in this document. For these we notify you by e-mail and in the app at least 30 days in advance, and we ask for a fresh acceptance before you continue using the app.

Minor changes are corrections, clarifications, updates to the sub-processor list, and statements about what data we process and for what purpose, where they change none of your rights and add none of your obligations. For these we inform you, without the 30-day notice and without asking for a fresh acceptance.

If you do not accept a material change, you can close your account and export your data; if you have a paid subscription, we refund the unconsumed part.

The version in force is the one published on this page, with the last-updated date and version number shown in the header. Previous versions remain available on request, at office@arvis.ro.

16. Discontinuation of the service

This is a young product, and it is fair that you know the worst case from the start.

We may decide to permanently discontinue the Arvis Loft service, in whole or in part, for objective reasons, namely: economic unsustainability; major technical reasons, such as losing an essential infrastructure supplier with no reasonable alternative; legislative changes that make provision impossible or unreasonably costly; or the company ceasing its activity. The list is exhaustive: we do not invoke other reasons.

In that case:

  • we notify you by e-mail at least 90 days before the discontinuation date;
  • data export remains available throughout the notice period, in all formats the app offers;
  • if you have a paid subscription, we refund pro rata the part of the paid period not consumed at the discontinuation date, without you having to ask. The refund is made within 14 calendar days of the discontinuation date, using the same payment method you originally used;
  • referral credits can be claimed for payout during the notice period;
  • after the discontinuation date we delete data in accordance with the Privacy Policy.

We charge nothing for discontinuation on our initiative.

16.1. If the company enters insolvency

If COMEXIM ELECTRONIX SRL enters insolvency proceedings or ceases its activity for reasons unrelated to continuing to operate the service, your rights are exercised under Law no. 85/2014. We tell you plainly what that means in practice:

  • we give the maximum notice the circumstances allow, through every available channel (e-mail, app, WhatsApp, public site);
  • data export remains available throughout the notice period and, where technically possible, for a further 30 days after operations cease;
  • amounts paid in advance for unconsumed periods are recovered by filing a claim in the insolvency estate - a formal request addressed to the court-appointed insolvency administrator;
  • we do not hold the money you pay in a separate (escrow) account. In plain terms: in such proceedings you are an unsecured creditor. The law sets an order of payment, and in it you come after the costs of the proceedings, secured banks, salaries and taxes - you are paid out of what is left, if anything is. We say this bluntly because it is exactly what you need in order to decide whether to pay a year up front;
  • we publish the appointed insolvency practitioner's details as soon as we have them, and you can also turn to ANPC (anpc.ro) for assistance.

We tell you this before you buy, not after: it is what you need in order to decide whether to pay for an annual subscription up front. This clause does not limit your statutory rights; it makes them explicit.

16.2. If the service is interrupted without notice

The section above covers a discontinuation decided in advance, and section 21 covers force majeure. What remains is the case in between: the service goes down suddenly, for reasons we cannot remedy and that fall short of force majeure.

If the service is interrupted for more than 30 consecutive calendar days in such a situation:

  • we notify you as soon as possible, through every available channel;
  • we refund in full the amounts paid for the affected period - not pro rata, but in full, as compensation for the absence of the service;
  • we make the latest available export available to you even if the app is no longer reachable; you can request it at office@arvis.ro;
  • if the interruption exceeds 60 days with no clear prospect of restoration, we treat the situation as permanent discontinuation, with the refund and export regime in section 16.

17. Suspending and restricting the account

We may suspend the account, restrict access to certain features, or remove content if:

  • you breach these terms, in particular section 8;
  • you use the service unlawfully or in a way that infringes others' rights;
  • you endanger the security, integrity or availability of the platform;
  • we are required to do so by a court order or a decision of an authority.

We tell you why. Except where the law forbids it, we communicate to you by e-mail the measure taken, the specific reason and its basis (a clause in these terms or a legal provision), the duration if it is temporary, and how you can challenge it. Challenges go to office@arvis.ro and receive a reasoned reply, assessed by a person, not by an automated system. If the measure was wrong, we lift it and restore access.

We always choose the least restrictive measure that solves the problem. Suspension does not delete your data; it remains recoverable for the duration of the measure.

18. Reporting illegal content

If you find content in Arvis Loft that you consider illegal, you can report it to office@arvis.ro. So that we can act, the report should contain: an explanation of why you consider the content illegal, the exact location (link) where it is, your name and e-mail (except for reports concerning offences against the sexual life and sexual freedom of minors), and a statement that the information in the report is, to your belief, accurate and complete.

We acknowledge receipt, examine the report in a timely, diligent and non-arbitrary manner, and inform you of our decision and the available remedies. Where we use automated means in processing a report, we tell you.

19. Closing your account, data portability and exit

You can close your account at any time, in Settings → Privacy or by a request to office@arvis.ro. We do not ask for reasons and we charge no exit fees.

Portability and exit (Regulation (EU) 2023/2854, the "Data Act"). So that you can leave without losing anything:

  • Export is available at any time, directly from the app (Settings → Your data), in commonly used, machine-readable formats. We charge nothing for export or for switching to another provider.
  • Exportable data covers everything you entered or imported and everything generated by your use (birds, pedigrees, races, training, results, health journal, photos, notes). Not exportable are elements belonging to our software: code, templates, calculation models and other items protected as intellectual property or trade secrets.
  • You can initiate a switch to another provider or to your own infrastructure by notice, with a notice period of no more than 2 months. The transition completes within 30 calendar days of starting; if that is technically impossible, we tell you why and agree a longer period, within the limits of the law.
  • You may request complete erasure of your data within 30 days of the contract ending.
  • On request we provide information about data structure, export formats and any technical restrictions.

What happens on closure. Deletion does not run immediately: a grace period follows, during which the account stays functional and you can cancel with one click. When it expires, data is permanently deleted, including uploaded files. Details in the Privacy Policy.

Inactive accounts. If a free account is not used at all for 24 months, we write to you by e-mail and, if we hear nothing within 30 days of that warning, we may close it and delete the data. Accounts with an active subscription are not affected. We do this because keeping data indefinitely with no purpose is not fair to you either.

Your own copies. We make backups of the platform, but they serve system recovery, not individual recovery of data you deleted yourself. We recommend keeping your own export periodically.

20. Warranties and liability

We strive to make the service work correctly and continuously, but we cannot guarantee that it will always be free of errors or interruptions. The service is provided "as is", to the extent permitted by law.

We are not liable for:

  • the accuracy of content you enter or import (section 9) and of data pulled from external sources or via AI scanning that you have confirmed (section 10);
  • decisions you take based on the data or statistics in the app (pairings, sales, race entries);
  • unavailability caused by third-party infrastructure providers, your internet connection or your device;
  • data loss caused by you deleting it, or by a person who accessed your account with your credentials.

These limitations apply without prejudice to the rights consumer protection law reserves to you. Under Legea 193/2000 on unfair terms, we do not exclude or limit liability that cannot lawfully be excluded: for intent or gross negligence, for personal injury or death, for non-conformity of the digital service within the meaning of OUG 141/2021, nor liability reserved to consumers by law. We do not restrict your right to go to court. Any unclear term is interpreted in the consumer's favour.

If you are a consumer and the paid service is not in conformity, you have the remedies in OUG 141/2021, described in the Refund and Withdrawal Policy.

For users who are not consumers, our total liability for any claim relating to the service is limited to the amount you paid in the last 12 months and does not cover lost profit or indirect losses.

21. Force majeure

Neither party is liable for non-performance caused by a force majeure event within the meaning of art. 1351 of the Romanian Civil Code: unforeseeable and insurmountable events outside reasonable control, such as natural disasters, armed conflict, major power or internet outages, large-scale cyber-attacks, or decisions of authorities. The affected party notifies the other without delay. If the situation lasts more than 60 days, either party may terminate the contract, with a refund of the amount paid and not consumed.

22. Assignment and change of control

You may not assign your account or your rights under this contract without our written agreement.

We may assign the contract to a company within the same group or, as part of a merger, acquisition or business transfer, to the acquirer, provided your rights are not diminished. We notify you at least 30 days in advance. If you are a consumer and do not agree, you may terminate the contract, with a refund of the unconsumed part. Any transfer of personal data in this context complies with the Privacy Policy.

23. Notices

We send notices to the e-mail address in your account; keeping it current is your responsibility. A notice is deemed received on the working day following dispatch. You can notify us at office@arvis.ro. Important notices are also shown in the app.

24. Final provisions

  • Severability. If a clause is held void or unenforceable, the rest of the contract remains in force, and the clause is replaced by the legal rule closest to the original intention.
  • No waiver. A party's failure to exercise a right, or delay in exercising it, is not a waiver of that right.
  • Entire agreement. The documents in section 2 form the entire understanding between us regarding the service. This does not limit liability for statements made in bad faith.
  • Language. The contract is available in Romanian and English. In case of discrepancy, the Romanian version prevails.
  • Machine translation. Some texts may be translated; in case of doubt, the Romanian version is the correct one.

25. Governing law and dispute resolution

These terms are governed by Romanian law. Any dispute is resolved amicably where possible; write to us first at office@arvis.ro. We answer any complaint within 30 days at the latest.

If we do not reach agreement, you may turn to:

  • ANPC (Romania's National Authority for Consumer Protection): anpc.ro
  • SAL (Alternative Dispute Resolution), through the ANPC platform: reclamatiisal.anpc.ro

The European ODR platform was shut down on 20 July 2025 by Regulation (EU) 2024/3228 and can no longer be used.

The competent courts are those provided by Romanian law; as a consumer, you may bring proceedings before the court of your own domicile. We do not impose arbitration and we do not restrict the competent court.

Questions about these terms? Write to us at office@arvis.ro or on WhatsApp at +40 741 250 134.

What changed

A summary of the changes to this document. Previous versions are available on request at office@arvis.ro.

  1. August 21, 2026

    We rewrote in plain language what happens if the company enters insolvency. The substance is unchanged, only explained: what "unsecured creditor" means and why it matters before you pay a year up front.

  2. August 21, 2026

    We wrote down what happens in three situations that were missing: if the company enters insolvency, if the service is interrupted without notice, and how quickly you get your money back on a shutdown (14 days). Plus the right to contest an automated decision and ask for human intervention.

  3. August 20, 2026

    We defined explicitly what counts as a material change and what counts as a minor one. No deadline is shortened: a change that affects your rights still comes with 30 days’ notice.

  4. August 14, 2026

    We added Sentry to the sub-processor list, clarified that PostHog does not load before your consent, and confirmed the age requirement at signup.

  5. August 13, 2026

    First published version of the documents.
